NYS Secure Choice Savings Program

New York State Secure Choice Savings Program – Effective March 18, 2026

The New York State Secure Choice Savings Program (New York Secure Choice) is New York’s retirement savings program for private-sector employees who do not have access to a retirement plan at work and provides an easy way for employees working in New York State to save for the future and is simple for employers to facilitate. Through automatic enrollment and payroll deduction, savers can contribute to Roth Individual Retirement Accounts (IRAs).

While the program launched in late 2025, March 18, 2026 marks the first mandatory registration deadline for employers with 30 or more employees. 

Does this apply to my organization?

Yes, if your organization:

  • Has been in business for at least two years.
  • Employed 10 or more employees in New York in the previous calendar year; and
  • Does not offer employees a qualified retirement plan (e.g., 401(k), 403(b), SIMPLE IRA, SEP IRA). 
Now what?

1. Register for the program by the deadline 

Your deadline depends on your New York employee count:

  • 30+ employees: March 18, 2026
  • 15–29 employees: May 15, 2026
  • 10–14 employees: July 15, 2026

2. Take action if you receive a compliance notice

If the state contacts you regarding your registration status:

  • Respond promptly through the Secure Choice portal.
  • Determine whether you must register or certify your exemption.

3. Inform employees of the act

Employers who meet the eligibility requirements are required to distribute the New York State Auto Enrollment Fact Sheet to qualifying employees.
