As you head into 2026, here are the key items NY construction employers must act on:
1. NEW for 2026: Electronic Certified Payroll
All Article 8 public/prevailing wage projects must submit certified payroll electronically every 30 days through the NYSDOL portal. Penalties: may be up to $100/day for late or missing reports.
2. Required Job‑Site Postings (Annual Reminder)
Fair Play Act, NYS Labor Law notices, federal OSHA/EEO/USERRA, and election postings (10 days prior).
3. Leave, Wage‑Hour & Timekeeping Compliance (Ongoing)
Ensure handbooks reflect NYS Sick Leave, PFL updates, Prenatal Leave, Voting/Jury rules, overtime, and timekeeping.
4. Fatality & Serious‑Injury Reporting (Required)
OSHA requires immediate reporting of fatalities and rapid reporting of amputations, hospitalizations, and severe injuries.
5. NYS Construction Fatality Reporting (State Requirement)
Contractors must report all construction‑related fatalities to the NYS DOL Construction Industry Fatality Registry using the required form. This is in addition to OSHA reporting.
6. OSHA February & March Reporting (Required)
All construction NAICS codes must report; required data varies by company size.
